On March 15, 2020, Daily Ittefaq published a news about the death of a construction worker due to electrocution in Muladi. According to published news, a construction worker named Moksed was electrocuted while laying tiles on a house in Sholghar village of Muladi in Barisal district. Moksed is the son of Helal Sardar of that village
Amena Begum (27) husband deceased Moksed Sardar. Currently she is living in Dhaka Mohammadpur. She was born in Diu Bepari village of Phulpur upazila of Mymensingh district.She got married while studying in class ten in this school. Her husband was a construction worker. On 14 March 2020, her husband died of electrocution while laying tiles at Dr. Shahjahan’s house in his own village.
Moksed Sardar, a construction worker, tragically lost his life in an accident while carrying out his duties. He was electrocuted by the wire of a tile cutting machine while laying tiles at a house under construction owned by Dr. Shafiq Khalifa in their village. Shockingly, Moksed Sardar did not receive adequate personal protection while performing his tasks.
After the accident, the Safety and Rights Society gathered detailed information about the incident. Amena Begum, wife of the worker was informed about the legal entitlements or compensation by the SRS. Subsequently, Amena Begum sent the notice to the owner via registered post on 29/09/2020. However, the owner did not respond to the notice.
On February 23, 2021, a case was filed in the Barisal Labor Court under case number 01/2021. After the case was filed, on 14/12/2022, the Learned Labor Court Barisal ruled in favor of the plaintiff, directing the opponent to deposit 2 lakh taka as compensation to the court within 30 days.
However, the opponent decided to appeal against the decision, contrary to the provisions of the law. As per legal procedure, the entire amount of the judgment from the lower court was required to be submitted to the labor court, and then an appeal could be filed. Since the opponent failed to follow this process, a criminal case was filed against the owner to enforce the judgment.
Following the filing of the criminal case, an arrest warrant was issued against the owner. When the owner inquired about the execution of the court judgment on 20/09/2023, the owner’s lawyer informed him about the appeal. The court, displeased with this action, ordered the owner to be sent to jail as he had appealed without depositing the judgment money in the court.
In response, the owner sought bail, agreeing to pay compensation as a condition. Finally, on 20/09/2023 at 7 pm, the owner was released from the case after paying BDT 200,000/- in cash to the plaintiff as compensation
Amena’s perseverance and timely documentation contributed to her legal victory. Overcoming intimidation and attending court for five days, she secured compensation after two and a half years. Despite doubts from neighbours, Amena held onto hope, emphasizing the importance of justice.
Amena plans to secure her children’s future with the compensation, intending to open Fixed Deposit Receipts (FDRs) in their names. She aspires to educate her son up to higher secondary and support her daughters’ education.
