Brief of accident
On 21/08/2015 Manik Miah, aged about 35 years was a worker, was working in N J S Consultant Ltd. under CWASA, Madonghat, Hathazari, Chattogram when he was hit with iron pipe and thereafter he was admitted to Chattogram Medical College Hospital where he was declared dead.
Process of Identification
SRS went to CWASA for collecting information about deceased worker as its routine work. SRS visit at workplace area and collect Manik Miah’s dependent address. SRS contact with the dependents of deceased including his mother. SRS collect information about accident from the dependent of deceased and make aware of his rights. Deceased family depends on his income totally.
Working process of SRS
After collection of data the interviewer consulted with legal department of SRS in this matter. Legal department contacted with dependent of deceased and make aware about her right on Labour Law over phone. After knowing her right dependent agreed to file compensation suit with the help of SRS and sent documents to SRS office. After getting documents firstly SRS drafted a petition and sent to BLAST for filing before 1st Labour Court Chattogram. In addition the case has been placed before the respective court on 11 March 2018. The case number is 09/2018 and now the case is disopsed. Finally the case is withdrawn on 29 August 2018 through mutual understanding between the dependent of deceased and employee.
Present Condition
Manik Miah’s mother depends on Manik Miah’s income. Deceased family ruined totally in case of his death. At present the dependent of deceased is living very much helpless. Due to lack of money she is unable to maitain her family properly. At a time she is disappointed for justice and she has no trust to state and society. SRS suggests her to be patient. In addition defendant’s lawyer informs to SRS’s panel lawyer that defendant agrees to compromise with petioners through giving at an amount of Tk.100000/-. The dependent of deceased also agree to take money and withdraw the case. Finally the case is withdrawn on 29 August 2018 through mutual understanding between the dependent of deceased and employee. After getting at Tk. 100000/- she is very pleased. She thanked SRS. She will spend some money to build home and some money is also spent to buy agricultural land for maintenance of her daily life. SRS hopes that deceased family will live in peace and happy.
