Md Faruk is a permanently disabled worker. He had been working at Dhaka Textile Mills for 22 years. On July 15, 2018, he was seriously injured when a bundle of clothes fell on him while he was working in the factory. After about 7 months of treatment, he could not return to his previous condition. Since then he has been living a crippled life.
He was injured in an accident while working at Dhaka Textile Mill and was first treated at Dhaka Medical College Hospital and later at CRP Hospital in Savar. His family had to borrow money from various relatives in the neighborhood to meet the medical expenses. After the accident, the owner of Dhaka Textile paid part of the medical expenses at the Dhaka Medical College Hospital, but the owner did not cooperate during the treatment at the CRP Hospital. On his part, the owner was contacted several times for communication and financial assistance, but they refused to pay the medical expenses
.According to the Labour Act, a compensation of Tk.250000/- is required if someone is disabled due to an accident at work but the disabled worker Faruk was not paid any compensation by his employer
The SRS legal team sent a legal notice through the injured worker Faruk demanding medical expenses and compensation. As the owner did not respond after receiving the notice, the legal team decided to file a case for compensation against the owner of Dhaka Textile. On November 7, 2019, a case was filed in the Third Labor Court of Dhaka with the assistance of BLAST and Case No. was 1540/2019. About 2 years after the filing of the suit, the owner requested an out-of-court settlement of the dispute through conciliation. Last December 2021, the owner agreed to pay compensation of Tk.250000/- through negotiation. Finally, on January 6, 2022, Faruk’s wife withdrew the case from the court in his favor after getting Tk.250000/- as compensation.
Faruk, the worker injured in the accident, is happy to get the compensation after almost three and a half years. “I would never have been able to get this compensation without the support that Safety and Rights has given me,” he said. He said, I requested repeatedly while under treatment to the employer to help me as much as possible but they didn’t. Besides, I was not aware of this compensation as per law. I did not know anything about this compensation until I met the SRS staff. So I am very much thankful to SRS
